Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Effie’s websites and services.

The F* It Team, Inc., doing business as Effie (“Effie,” “we,” “us,” or “our”) provides Effie, an AI-powered smart CRM platform and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to accept these Terms on that organization’s behalf.

If you do not agree to these Terms, do not use the Service.

1) Who We Are and How to Contact Us

2) Eligibility and Intended Use

2.1 Age and eligibility

You must be 18 or older to use the Service. We do not verify age by collecting birthdates.

2.2 Intended industry

Effie is intended for U.S. real estate use cases. You agree not to use the Service for other industries or purposes that would violate these Terms, applicable law, or our providers’ policies.

3) Accounts, Companies, and Collaboration

3.1 Accounts and “Company” workspace

When you sign up, a company workspace may be created for you by default. Effie is a collaborative tool: depending on your plan and settings, you may invite additional users to your company workspace, and data you add may be visible to other authorized users in that workspace.

3.2 Seat rules

  • By default, one user equals one seat.
  • Some plans may allow multiple seats per company workspace.
  • Our Unlimited Pro plan (if offered) requires a minimum of three (3) seats.

3.3 No account sharing

You may not share logins. For security reasons, credential sharing is not permitted and is not advised. You are responsible for all activity that occurs under your account.

3.4 Company disputes

Effie does not adjudicate internal company disputes about workspace ownership or data division. If there is a dispute, we may require a written and signed agreement from authorized parties detailing how data and access should be handled. Until we receive sufficient documentation, we may:

  • keep the workspace and Customer Data intact, and/or
  • restrict access to protect the parties and the integrity of the data.

3.5 Security requirements

  • MFA is required for account access.
  • Password rules may be enforced by the authentication system used by the Service.

4) Subscription, Fees, and Payment

4.1 Plans

Effie may offer free and paid plans. Features differ by plan and may change.

4.2 No free trial; promotions may exist

We do not offer a standard free trial. We may offer promotions, discounts, or coupons from time to time, but they are not guaranteed and may have specific eligibility rules.

4.3 Billing and renewals

Paid plans are billed in advance on a recurring basis (e.g., monthly or annually) as presented at checkout. Subscriptions renew automatically unless you cancel.

4.4 Price changes and lock-in window

If we increase pricing for your plan, we will provide notice and your current price will be locked in for 90 days from notice, after which the new price may apply (typically at renewal).

4.5 Late payments; downgrade

If payment fails or becomes overdue, we may restrict features, downgrade, or deactivate your account. As a general guideline, accounts may be downgraded after 72 hours of non-payment or unresolved billing issues.

4.6 Refunds

Fees are non-refundable by default. Refunds, if any, are granted case-by-case in our sole discretion (unless required by law).

5) Cancellation, Deactivation, and Data Retention

5.1 Downgrading

You may downgrade your plan, but downgrading may remove access to paid features and may also limit or lock access to some data or functionality until you upgrade again.

5.2 Cancellation and deactivation

If you cancel a paid subscription, your account may be deactivated and you may be locked out of the Service (including Customer Data), subject to any grace periods described in-product.

5.3 Retention and deletion timeline

After cancellation/deactivation or account closure:

  • we will hold Customer Data for up to 90 days, and then delete it, subject to legal, security, and dispute-related exceptions; and
  • backups may persist for up to 60 days.

You are responsible for exporting any Customer Data you wish to keep before cancellation or deactivation.

6) Customer Data, Permissions, and Privacy

6.1 Customer Data

Customer Data” means any data, content, or materials that you submit to or process through the Service, including contacts, property records, notes, messages, documents, and transcriptions.

You retain ownership of your Customer Data. You grant Effie a non-exclusive, worldwide, royalty-free license to host, use, process, transmit, display, and reproduce Customer Data only as necessary to:

  • provide and secure the Service,
  • provide AI features,
  • support collaboration within your workspace, and
  • comply with law and enforce these Terms.

6.2 Your responsibility for Customer Data and permissions

You are responsible for:

  • the accuracy, legality, and content of Customer Data,
  • obtaining any necessary rights and permissions to upload and use Customer Data,
  • configuring sharing appropriately within your workspace, and
  • complying with any laws that apply to your collection and use of Customer Data.

6.3 Collaboration and visibility (including Effie/Frontdoor team access)

Effie is a collaborative app, and Customer Data may be shared with other authorized users you add to your workspace.

In addition, Effie team members (including Frontdoor/Effie operations personnel) may access Customer Data only as needed to provide customer support, maintain the Service, investigate abuse, or secure the Service, as described in Section 12 (Support Access).

7) Messaging & Communications Compliance (TCPA, Consent, Opt-Out)

Effie may enable messaging and communications features through third-party providers (such as Dialpad, Twilio, and Gmail/Google). These features can include SMS, calling workflows, and email integrations.

7.1 You are responsible for compliance

You agree that you are solely responsible for your communications and for compliance with all applicable laws and rules, including without limitation:

  • the Telephone Consumer Protection Act (TCPA) and related regulations,
  • state telemarketing and privacy laws,
  • Do Not Call (DNC) obligations and internal DNC lists,
  • consent requirements, disclosure requirements, and recordkeeping, and
  • carrier/provider policies (including A2P and opt-out requirements).

7.2 Consent and permitted messaging

You represent and warrant that you have obtained and will maintain all required consents, permissions, and legal bases to contact recipients using the Service.

7.3 Opt-out and quiet hours

You are responsible for honoring opt-out requests and respecting applicable “quiet hours” or time-of-day restrictions. We strongly recommend supporting common opt-out keywords (e.g., “STOP”) wherever your providers support them.

7.4 Provider enforcement and feature suspension

Communications providers and carriers may filter, block, or flag messages. We may restrict, suspend, or disable messaging features (or your account) if:

  • you violate laws or provider policies,
  • your messaging causes unusual complaint rates, filtering, or carrier enforcement, or
  • we believe your usage creates legal, reputational, or operational risk for Effie or our providers.

7.5 No delivery guarantees

We do not guarantee delivery, timing, or availability of messaging/calling/email features due to dependencies on third-party providers and networks.

8) AI Features (Core to Effie)

Effie is an AI-powered platform. Using Effie means AI processing is part of your experience.

8.1 AI outputs may be wrong

AI features can generate content that is inaccurate, incomplete, misleading, or fabricated (“hallucinated”). AI outputs are provided for informational/support purposes only and should be reviewed by you before use. You are responsible for verifying outputs and for any decisions or actions taken based on them.

8.2 No opt-out

AI functionality is core to Effie. There is no opt-out from AI processing within the Service. Using Effie is opting in.

8.3 No automated “high-impact” decisions

Effie does not use AI to make automated decisions that, by themselves, produce legal or similarly significant effects (e.g., credit eligibility, employment, housing eligibility).

8.4 Third-party AI providers

To provide AI features, Effie may send Customer Data and user content (including property data, notes, and transcriptions) to third-party AI providers (including OpenAI), in accordance with our Privacy Policy.

8.5 Aggregated and anonymized metrics

We may collect and use aggregated and/or anonymized data and metrics about usage of the Service (including feature performance and system health) to operate, protect, and improve Effie. Such data is not intended to identify you.

9) Third-Party Data, Integrations, and Accuracy

Effie may connect to or surface information from third-party sources (e.g., BatchLeads, RentCast via RapidAPI, Redfin, and others) and communications providers.

You acknowledge that:

  • third-party data may be inaccurate, incomplete, delayed, or outdated;
  • availability, pricing, and access to third-party services may change; and
  • Effie is not responsible for third-party services, their content, or their downtime.

You are responsible for checking critical information before acting on it.

10) Acceptable Use and Restrictions

You agree not to:

  • use the Service for illegal, harmful, deceptive, or abusive activity;
  • violate any law, regulation, or provider policy (including messaging and privacy laws);
  • send spam or harassment, or contact people unlawfully or without required consent;
  • attempt to bypass security, rate limits, or access controls;
  • reverse engineer or attempt to extract source code (except where prohibited by law);
  • interfere with the Service or its infrastructure; or
  • misuse APIs or automation in a way that degrades the Service or risks provider enforcement.

We may suspend or terminate accounts for suspected illegal activity, policy violations, or abuse.

11) Intellectual Property and Branding

11.1 Effie IP

Effie owns the Service and all related intellectual property (excluding Customer Data). We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business or personal use in U.S. real estate, subject to these Terms.

11.2 Your Customer Data

You retain ownership of Customer Data.

11.3 No use of Effie branding

You may not use Effie’s name, logos, trademarks, or branding in marketing, advertising, or public materials without our prior written permission.

11.4 Marketing reference

You grant Effie permission to use your company name and logo to identify you as a customer in our marketing materials (e.g., on a customer list), unless you notify us in writing to opt out at: support@effieapp.ai.

12) Support Access (Limited)

Effie personnel may access Customer Data only as reasonably necessary to:

  • provide customer support you request,
  • maintain and secure the Service,
  • investigate abuse or policy violations, or
  • comply with law.

We do not access Customer Data for other purposes. Access is limited to authorized personnel and subject to security controls.

13) Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.”

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Not a law firm / not legal advice: Effie is not a law firm and does not provide legal advice. You are responsible for seeking professional advice (including legal advice) as needed.

We do not warrant that:

  • the Service will be uninterrupted or error-free,
  • AI outputs or third-party data will be accurate or reliable, or
  • messaging/email will be delivered.

14) Limitation of Liability

To the maximum extent permitted by law:

  • Effie will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business, or goodwill.
  • Effie’s total aggregate liability arising out of or relating to the Service or these Terms will be limited to the amount you paid to Effie in the twelve (12) months immediately before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some limits may not apply to you.

15) Indemnification

You agree to indemnify, defend, and hold harmless Effie and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of the Service,
  • your Customer Data,
  • your communications and messaging activity (including TCPA/DNC compliance),
  • your violation of these Terms, or
  • your violation of any rights of another person or entity.

16) Arbitration Agreement (READ CAREFULLY)

This section includes an arbitration agreement and class action waiver that affects your rights.

16.1 Agreement to arbitrate

You and Effie agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief in court to prevent actual or threatened misuse of the Service, infringement, or unauthorized access.

16.2 No class actions

You and Effie agree to bring Disputes only in an individual capacity and not as a plaintiff or class member in any class, consolidated, or representative action.

16.3 Arbitration rules and location

Unless you and Effie agree otherwise:

  • arbitration will be administered by AAA under its applicable rules,
  • the arbitration will take place in Travis County, Texas (Austin area) or remotely if permitted, and
  • Texas law will govern these Terms (without regard to conflict of laws).

16.4 Time limit to bring claims

To the extent permitted by law, any Dispute must be brought within one (1) year after the claim arises, otherwise it is permanently barred.

17) Governing Law (If Arbitration Is Not Enforceable)

If the arbitration agreement is found unenforceable for a particular claim, you agree that claim will be brought exclusively in the state or federal courts located in Austin, Texas, and you consent to venue and jurisdiction there.

18) Changes to the Service and These Terms

We may update the Service and these Terms from time to time. If we make material changes, we will provide notice (e.g., by email, in-app notice, or updating the “Last updated” date).

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

19) Miscellaneous

  • Entire agreement: These Terms and the Privacy Policy form the entire agreement regarding the Service, unless superseded by a written agreement signed by Effie.
  • Severability: If a provision is invalid, the rest remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. Effie may assign these Terms in connection with a business transfer.
